KANSAS CITY, Mo. - Shocking developments surfaced Tuesday in a Clay County courtroom.
Dallas Bogard, 25, was released from prison after the medical examiner ruled the death of his fiancé's toddler was an accident.
Bogard told police a bookshelf fell on the 2-year-old boy he was watching while his fiancé was at work in January. The boy's mother had told police she didn't believe his story, and that the bookshelf was too small to fracture her son's skull.
"We will go back and look at the entire case file, and if we can move forward on something, we will," said Dan White, Clay County prosecutor.
Bogard's charge of first-degree assault has not yet been dropped, and the case is not dismissed. White says the charge will be re-evaluated.
