KANSAS CITY, Mo. — A man has been charged in an assault connected to the death of a Lee's Summit police officer at Californos Restaurant in Westport.

Jeremiah C. Crow is charged with third-degree assault in the August 20 incident where 30-year-old Thomas Orr was shot and killed.

Another man, Sean Steward, 22, was charged with second-degree murder, first-degree assault, and two counts of armed criminal action in Orr's death.

Orr was off-duty and eating dinner when he was shot and killed at Californos. He's not believed to be involved in the events that led up to the assault and shooting.

According to court documents, a witness claimed she saw someone punch a man in the back of the head and then run away.

While fleeing, Crow fell down some steps and when he got up he allegedly pulled out a gun and fired shots into a crowd. The witness also saw a second man run past her with a gun and fire shots towards Orr and the other victim, according to officials.

The witness showed investigators Facebook photos of the man who threw the punch.

According to documents, the man who was punched said he didn't see his attacker but that witnesses told him it was Crow. He also told investigators that he and others had gotten into an altercation with Crow a few years ago and that he believed Crow was retaliating. He later picked Crow out of a photo lineup.
