KANSAS CITY, Mo. — A man was taken into custody after he walked into a Lee's Summit preschool on Monday morning with a gun, police said.

Around 11 a.m., officers responded to the Early Childhood Center of Our Lady of the Presentation Catholic Church at 150 Northwest Murray Road on reports of a suspicious person. A receptionist told police a man entered the preschool facility and was "acting erratically," police said in a news release.

Staff at the school, fearing he was armed, put the facility on lockdown, and a staff member got the man to exit the building, police said. School staff then locked the door and notified police.

Officers took the man into custody without incident and took a weapon from him, police said.

Lee's Summit police spokesman Sgt. Chris Depue said the man appeared to be intoxicated. No injuries were reported, and children were isolated from the threat during the incident, according to police.

Jackson County Prosecutors charged 40-year-old Phil J. Spurgeon of Lee's Summit with a felony count of unlawful use of a weapon Monday night. His bond was set at $25,000.

By 1:30 p.m. Monday, the school had resumed normal operations.

Editor's note: Based on 41 Action News' new mugshot policy, the decision was made to remove Spurgeon's police-provided photo, which was posted with the original story, after he was found not guilty at trial on Oct. 7, 2020.
