A 23-year-old man was shot and killed after an overnight disturbance in the 3900 block of Denver Avenue in Kansas City, Missouri.
Officials later identified the man as Austin Cupp.
Police say Austin Cupp (left) was the man fatally shot at 39th and Denver over the weekend.
MarKivius C. Woods, 23, has been charged in the fatal shooting. He faces second-degree murder charges and armed criminal action.
According to court records, officers were called on a reported shooting. When officers arrived they saw shell casings in the area. Cupp was shot and transported to the hospital where he later died.
Woods told officers he went to the house to see his child when he encountered Cupp, court documents said. Woods pulled a gun and fired a "warning shot" at Cupp who lunged at him as he fired two more shots, officials said.
Woods told police he didn't mean to kill Cupp.
Prosecutors have requested a $250,000 bond for Woods.
