Murder suspect back in custody after being mistakenly released from jail 5 months ago

An inmate from a Raytown murder was mistakenly released from the Jackson County Detention Center earlier this year, is back in custody.

Independence police say they were called around 7:35 a.m. Sunday to the 3800 block of south Canterbury for a suspicious vehicle. 

When they arrived, they saw a man sleeping in a vehicle. He was later identified as Malcolm D. Johnson, officials said. 

The a 26-year-old Kansas City man, was charged with second-degree murder and armed criminal action in connection with the shooting death of 22-year-old Monteario Hogan, in 2014, at a shopping center in the 5200 block of Blue Ridge Boulevard in Raytown.

In March, 41 Action News obtained emails, phone calls and video from the Jackson County Department of Corrections, where employees in the records department mistakenly released an accused murderer last month.

Documents show the prosecutor’s office dismissed Malcolm Johnson’s charges and then minutes later refiled them. All of the information showed up in the jail’s computer systems, but the employees in the records department didn’t pay close enough attention.

More than 24 hours later, Johnson was mistakenly released.

On Feb. 16, a Raytown detective delivered the new arrest warrant to the jail around 5 p.m. By 10 p.m. on Feb. 17, Johnson was out.
