Brothers charged in shooting death of a man during drug deal

KANSAS CITY, Mo. — Two brothers have been charged with shooting and killing a man they thought tried to set them up to be robbed.

Michael Sherman, 27, and his brother, Malik Sherman, 23, both of Kansas City, Missouri, were charged Friday in Jackson County with second-degree murder, two counts of armed criminal action and kidnapping.

The brothers told police they had taken the victim, Andre Tolan, with them in a car Thursday night to buy some marijuana, according to court records.

As they approached the area of the transaction, the brothers both told police they saw a man walk toward them with a gun.

Michael drove away, firing a .40-caliber handgun at their perceived robber. He drove to the East Hills Village Apartments in the 7600 block of Monroe Avenue, where the men forced Toland from the car at gunpoint.

The brothers said they both shot Toland, Malik with a rifle and Michael with a handgun, according to a probable cause statement.

Toland staggered from a breezeway at the apartment and fell to the ground outside an apartment building. He died at the scene.
