Deadline set to file impact statements in Atchison Clean Air Act Case

KANSAS CITY, Mo. — Victims in the Atchison Clean Air Act case have until Friday to file written impact statements.

A federal judge has set a May 27, 2020 hearing for the sentencing of Harcros Chemicals, Inc. and MGP Ingredients Inc. According to U.S. Attorney Stephen McAllister, both violated the federal Clean Air Act when a cloud of toxic chlorine gas formed over Atchison, Kansas in 2016.

“Many people were affected by the release of the gas in Atchison,” said McAllister. “We know that 140 individuals including members of the public, first responders, employees of MGP Ingredients and Harcros Chemicals sought medical attention at the time of the incident.”

Both companies pleaded guilty and agreed to pay a one million dollar fine.
