Missouri Sen. Will Kraus (R - Lee's Summit) has introduced Senate Bill 811, a bill that would restrict the use of cell site simulator devices.
Cell site simulators are used by law enforcement to pinpoint an exact location of a cellphone or any individual they are tracking.
If approved, this bill would place the same restrictions on cell site simulators that exist for phone tapping methods, as both state and local law enforcement agencies would be required to obtain a warrant before using them.
A judge would have to issue a warrant for the use of this device. A law enforcement officer would submit an affidavit that specifies certain facts about the case.
There are exemptions. A kidnapping or reported suicide attempts would be exempted from the bill.
Owners of stolen phones could also authorize the device to be used in locating their phones.
