Accused killer found passed out in pickup truck next to a stolen rifle

Accused killer Malcolm Johnson got out of the Jackson County Jail by mistake. He's back in custody and facing a new charge. 

Jackson County prosecutors charged Johnson, 27, with unlawful possession of a firearm after court documents say he was found August 14 with a stolen rifle next to him.

It had been six months since Johnson's mistaken release from the Jackson County Jail. He was in jail on second-degree murder and armed criminal actions charges when he was set free.

The search for Johnson ended when an Independence police officer found him and two other men passed out in a pick up truck next to a curb in the 3800 block of Canterbury Place in Independence.

One officer removed the black SKS Norinco rifle from the truck and told Johnson not to move, according to court documents.

The officers found out the rifle was stolen and arrested Johnson.

He lied about his name, but a fingerprint check confirmed his identity, court documents state.

Johnson told police he couldn't remember much about what happened to land him passed out in a truck.

He said he spent the night before his arrest drinking heavily and using a large amount of cocaine, according to court documents.
