Letter: Investigation finds former KU football player had 'non-consensual sex' with former rower

The University of Kansas sent letters to two former KU rowers with results of investigations by an office at the school, with one finding a football player had "non-consensual sex" with one of the rowers. 

Now, the former football player accused of sexually assaulting the two former rowers has been dismissed from another university football program.

41 Action News has learned the student, who was never criminally charged, enrolled at Indiana State University. He was on the football roster this year until August 25.

An ISU spokeswoman sent 41 Action News the following statement:

"The upper administration of the athletics department and football team recently learned more information about [the student*] and after a review, decided it was best for him to focus on obtaining his degree. Steps have been taken to ensure this situation is not repeated."

While attending KU, the two former rowers accused a football player of sexually assaulting them in the Jayhawker Towers. Several lawsuits have been filed against the university by the rowers and their parents, accusing the university of falsely advertising a safe dorm life on campus and failing to protect students in campus housing.

41 Action News obtained two letters sent to the rowers in March, which explained the results of investigations conducted by KU's Office of Institutional Opportunity and Access. According to the letters, one investigation found the football player had "non-consensual sex" with one of the rowers and violated the school's sexual harassment policy in the other case.

The letters said the football player "has been effectively permanently expelled" and would not be eligible for readmission. "A notion will be placed on [his] transcript" and he "has been banned from campus for a period of ten years," according to the letter.

A KU spokeswoman would not provide the university's policy when it comes to transcripts and expelled or suspended students. She also did not respond when asked to clarify what notion was placed on this student's transcript.

KU did send a statement to 41 Action News, which read: "we are confident the courts will agree that we've met our obligations to both [students]."
