KANSAS CITY, Mo. — A federal judge ruled Monday that former pharmacist Robert Courtney will stay in a federal prison.

Courtney argued he should be released because of the danger of contracting COVID-19 while in prison.

He pleaded guilty in April 2002 in federal court in Kansas City, Missouri to 20 charges, including tampering with consumer products.

According to previous reporting by 41 Action News, over a 10-year period,Courtney diluted an estimated 98,000 prescriptions given to nearly 4,200 patients, most of them battling cancer.

The judge's ruling states Courtney knew his diluting the cancer drugs would cause serious harm or death to cancer patients.

He's currently in a federal prison in Englewood, Colorado.

He was sentenced to 30 years in prison, with an expected release in May 2027.
