State shuts down day care after 3-month-old injured

Owner could face criminal charges

An in-home day care in Gladstone was shutdown after a 3-month-old was hurt.

According to documents obtained by the 41 Action News investigators, Missouri Department of Health and Senior Services revoked the day care's license in January after it found the owner "failed to provide adequate supervision to the children."

The investigation states the owner, who's not being named because she hasn't been charged, placed the 3-month-old in a swing while she used the bathroom.

The owner told investigators she placed a gate between the infant and the other children.

However, when the owner came out from the bathroom, she told investigators the infant was injured by a 2-year-old who climbed over the gate.

The report states the owner of the day care called the infant's mother and told her the baby was scratched by another child.

However, when the baby girl's father arrived, he was shocked and speechless by his daughter's injuries, according to the documents.

In addition to being scratched, the baby had bite marks around her feet, a bruised eye and various marks on her skin.

The girl was taken to Saint Luke's Hospital.

Doctors didn't find any serious injuries on the girl. Still, police were called.

According to the reports, the owner told a DHS inspector, the 2-year-old had a history of scratching other children and climbing the gate.

The inspector wrote, "You were aware of Child B's scratching tendencies and past attempts to climb over the gate but did nothing to protect Child A and the other children enrolled in your family child care home from Child B."

DHS found the owner was in violation of a statute that states, "Children shall not be permitted to intimidate or harm others, harm themselves, or destroy property."

The Clay County prosecutor's office said it's reviewing the case and that the owner could face felony charges of endangering the welfare of a child.
